Terms and Conditions


The following are the Terms and Conditions for purchases of products and services from UCOM Mobile, Inc. In order to place an order with our company, you must read and agree to the terms and conditions below. It is your responsibility to read and understand the terms and conditions completely and thoroughly, so please do not hesitate to contact UCOM Mobile, Inc. if you have any questions.

The terms and conditions hereinafter set forth constitute an agreement ("Agreement") for the rental and or purchase and use of the wireless communication device and peripheral equipment ("Equipment") offering by UCOM Mobile, Inc("UCOM"), including, but not limited to, wireless devices, SIM cards, data cards, mobile hotspots, user guides, chargers, adapters, and related or additional services (the “Services”). This Agreement is between the ("Renter" or “Purchaser” or "Customer"), and UCOM, located in Beijing, China. Both parties acknowledge that this Agreement consists of all the terms printed below as Terms & Conditions ("Terms"), as well as those contained in the Rental Agreement.

Acceptance of Terms and Conditions

If the Customer places an order via UCOM’s web site (www.ucomobile.com), this will constitute the Customer’s acceptance of the Terms and Conditions. If the Customer places an order via telephone, FAX, or any other method, acceptance of the Equipment shall constitute the Customer’s acceptance of these Terms and Conditions.

Rental Responsibilities

Renter agrees to accept responsibility for the equipment as provided by UCOM, which will be delivered to renter’s specified address in working condition and with all accessories and parts and manuals. Renter agrees to return the Equipment including said accessories and parts and manuals to UCOM at the conclusion of the rental period in the same condition as when received.

Rental Period

The number of days between the Pickup Date and Return Date.
The Customer will pay daily charges from the Pickup Date until the Return Date for all of the Equipment specified in the Terms and Conditions. Equipment rental charges apply to full days only (not fractional days).

Extension of Rental Period

Rental period can be extended if our stock allows.
The additional cost will be calculated based on the discounted rate of the original rental period.

Operation of Equipment

Equipment usage is limited to the China only (except Hongkong & Macau).

All products must be used for legitimate and legal purposes. We will terminate the contract if the customer fails to do so.

We require you to exercise reasonable care in the use of our equipment, and handle all the equipment in accordance with the instruction we provide.
Furthermore, you agree that you will not make any modifications, repaires or damage to all the equipment and that you are fully responsible and compensate if any of those is done.

Ownership of Equipment (Rental)

The Equipment will at all times remain property of UCOM. Customers have no rights other than temporary use. During the Rental Period, no service or part replacements are authorized without the written approval of UCOM.

Equipment Delivery

When place an order through UCOM website (www.ucomobile.com), Customer are asked to provide an address at which Customer desire to receive the product as well as pickup date. We are not liable for any cases that Customer fail to receive it although the product has been delivered in time at the right address.

UCOM will take responsibility for the Equipment during transportation to the Customer’s address as designated by the Customer.

When Customer receive it, it is Customer’s responsibility to check all the equipment and verify that it is in good working condition.

In any cases that UCOM have to inspect wether the delivery has been done in time or not, UCOM agree on that we fully trust what the delivery system claims.

Returns (Rental)

The Customer is required to proceed to return the equipment no later than midnight on the last day of the Rental Period. Customer shall leave the Equipment to the hotel concierge / front or other agreed address at the end of the Rental Period.

Customer should provide the return information when place order or before returning the Equipment. Customer is responsible for the accuracy of return address. The delay caused by a wrong return address will result delay fees.

The equipment must be returned in a good working condition otherwise it will result in compensation.

In case that you have lost the package for return we provide, you take responsibility to find an alternative way to return it and pay for it.

Cancellation and Refund

UCOM accept cancellation of the order at any time. However, the amount of refund depends on how early the Customer cancel the order.
Should you need to cancel your order, please send us an email with your order information.

  • No later than 1 week before the pickup date: Full refund
  • Within 6 to 4 days before the pickup date: 50% refund
  • Less than 4 days until the pickup date: No refund.

We consider the time when we received cancelation request via email as the accepting time.
Local time applies here.

Refund will be issued within 3 days from the day we receive the cancelation request via email.

Also, we do not refund in any cases other than the above.

Compensation

Delay

Failure to proceed to return the equipment promptly will result in the additional fees.
The additional fees will be calculated based on the discounted rate of the original rental period and will be charged until the day we actually receive the equipment.

Theft, Loss, and Damage

All customers are required to report any loss or damage caused during the rental period to the Company immediately and follow instructions given afterwards.
Any of those cases will result in the incurrence of additional charges stated as following, and all prices are in U.S. Dollars.

  • MiFi device: $100 (regardless the model)
  • SIM card (which comes with MiFi device): $30
  • Battery: $15
  • AC adapter: $20
  • USB cable: $5
  • Portable case: $15

If needed, we will cooperate with PayPal to collect the customer’s information in order to collect the compensation fees.
In the case the customer ignores or fails to pay the compensation fees, we might have to file the case to the courtof law.

Applicable Law

This Agreement shall be governed by the laws of China, without giving effect to its choice of laws or provisions.

By accepting this Agreement, Customer agree to indemnify defend, our officers, directors, employees, representatives, agents and other customers against any and all claims, demands, losses, costs or expenses, including but not limited to attorney’s fees, collection fees and court costs, in any way connected with a breach of this Agreement.
